§ 2-106. Powers of the special magistrate and appellate special magistrate.

  • Special magistrates and appellate special magistrates shall have the power to:

    (a)

    Adopt rules for the conduct of hearings. Adoption of rules for special magistrate hearings must be done by majority vote of all special magistrates at an open meeting. Adoption of rules for the conduct of hearings on appeals may be done by a majority vote of all appellate special magistrates at an open meeting. If the magistrates hold an open meeting to adopt rules, the first order of business must be the nomination and election by majority vote of a chairperson.

    (b)

    Subpoena alleged violators and witnesses to hearings. Subpoenas may be served by the sheriff of the county or police department of the municipality.

    (c)

    Subpoena evidence to hearings.

    (d)

    Take testimony under oath.

    (e)

    Issue orders. Special magistrates and appellate special magistrates may issue orders having the force of law to command whatever steps are necessary to bring a violation into compliance.

    (f)

    Establish and levy fines and costs in accordance with section 2-111 of this division 5.
