§ 2-105. Jurisdiction.

  • (a)

    General jurisdiction: Code enforcement special magistrates and appellate special magistrates shall have the jurisdiction to hear any alleged violation of any code or ordinance of Polk County that does not provide for an exclusive method of enforcement through other means including but not limited to violations of the Polk County Land Development Code, building code, and fire prevention code.

    (b)

    Orders existing prior to the creation of the code enforcement special magistrate system: All orders or decisions of the code enforcement board and special magistrate prior to the effective date of this division 5 shall remain in full force and effect. Special magistrates and appellate special magistrates shall have the authority to affirm, ratify, or amend any order, including orders imposing fines as liens, or decision rendered or imposed by the code enforcement board, hearing officer, or special magistrate prior to the effective date of this division 5.
