§ 2-104. Definitions.

  • (a)

    Polk County Board of County Commissioners: The governing body of unincorporated Polk County and may be referred to as "board", "county commission", the "county" or the "BoCC."

    (b)

    Code: Includes all codes promulgated by the Polk County Board of County Commissioners including but not limited to the Polk County Land Development Code and the Polk County Comprehensive Plan.

    (c)

    Code enforcement division: The division within Polk County government that is responsible for the enforcement of the codes and ordinances of unincorporated Polk County and may be referred to as "the Division."

    (d)

    Code enforcement officer: Any authorized employee of Polk County whose duty it is to investigate alleged violations of Polk County codes and ordinances, and may be referred to as "code enforcement investigator" or "code inspector."

    (e)

    Initial pleading: Refers to a notice of violation issued by a code enforcement investigator which serves as the basis for the enforcement action and explains to the alleged violator the nature of the violation, provides a reasonable amount of time for compliance and cites to the provision of the code(s) and/or ordinance(s) that have been violated.

    (f)

    Notice of appeal: A written document explaining that a party desires to appeal a special magistrate's written decision and detailing the reasons for such appeal.

    (g)

    Ordinance: Any ordinance, regulation, resolution or other form of legislation promulgated by the Polk County Board of County Commissioners. May be used interchangeably with "code."

    (h)

    Repeat violation: A subsequent violation, which may occur at a different location within unincorporated Polk County, of a county ordinance or code by a person who was previously found to have violated the same provision of the code or ordinance. The subsequent violation must occur within five (5) years of the date an order finding a violation was ratified by the code enforcement board or an order was entered by a code enforcement special magistrate or appellate special magistrate pursuant to this division 5.

    (i)

    Violator: Any person who causes or allows a violation of a Polk County ordinance or code to exist on property in which they have either an ownership or possessory interest. May include, but not be limited to, an occupant, tenant, lessee or owner.
