§ 2-111. Notice of appeals to the appellate special magistrate.

  • (a)

    Filing a notice of appeal: The code enforcement appellate special magistrate will hold a hearing upon the filing of a notice of appeal by either party. Such notice of appeal must be filed with the administrative staff of the code enforcement special magistrate by the party within ten (10) days of the date of the entry of a special magistrate's written order.

    (b)

    Computation of time: The ten-day appeal period shall begin to run the day after the entry of the order or the day after the certificate of service is dated, whichever is later. If the last day of the ten-day appeal period falls on a Saturday, Sunday or county-authorized holiday, then the notice must be filed by the end of the next business day immediately following the weekend or holiday.
