§ 2-29. 1977 plan.

  • (a)

    There is hereby established a Polk County employees' deferred compensation program.

    (b)

    The chairman of the board of county commissioners of Polk County is hereby designated as the official to approve and administer one or more deferred compensation plans in accordance with law.

    (c)

    The county attorney is hereby designated as the appropriate official to determine, in accordance with the requirements of Section 112.215(6)(b), Florida Statutes, whether the compensation deferred under any plan approved by the chairman of the board of county commissioners will not be included in the employees' taxable income under federal or state law until it is actually received by such employee under the terms of the plan, and that such compensation will nonetheless be deemed compensation of the time of the deferral for the purposes of Social Security, the retirement system of the county, or for any other retirement, pension or benefit program required by law.

    (d)

    The deferred compensation plan authorized hereunder and any other plan approved and adopted as herein provided, will exist and serve in addition to any other retirement, pension or benefit systems established by the federal government, the State of Florida or Polk County, and shall not supersede, make inoperative or reduce any benefits provided by the Florida Retirement System or by any other retirement, pension or benefit program established by law.

    (e)

    For the purpose of eligibility to participate in the program hereby established, the term "employee" shall include, without limitation, the members and employees of the board of county commissioners, the clerk of the circuit court and said clerk's employees, the property appraiser of Polk County and the property appraiser's employees, the tax collector of Polk County and the tax collector's employees, and the sheriff of Polk County and the sheriff's employees, and the supervisor of elections and the supervisor's employees.
