§ 10-109. Setbacks from public right-of-ways.

  • A setback of one hundred (100) feet shall be required for all mining activities conducted adjacent to a county right-of-way. A request for a reduction of this setback may be granted by the board upon the certification of a professional engineer that no structural degradation will occur to the right-of-way as a result of the mining related activity. At no time, shall this setback be reduced to less than fifty (50) feet from the right-of-way. A protective berm shall be erected, prior to and during the mining of lands adjacent to the setback from a right-of-way. Such land shall be reclaimed within one (1) year after it has been disturbed.
