§ 5-284. Unsafe swimming pools.

  • (a)

    The building official is hereby empowered, upon request of an owner, the Polk County Health Department, the Polk County Fire Marshal, or an immediately adjacent land owner to inspect or reinspect an unoccupied pool structure which constitutes a detriment to the public welfare by reason of inadequate maintenance, dilapidation, obsolescence or abandonment. Such pool structures are severally in contemplation of this section declared to be an attractive nuisance. Upon such declaration, the building official may require the owner to:

    (1)

    Repair the swimming pool structure; or

    (2)

    Demolish the swimming pool structure and remove the debris; or

    (3)

    Secure the premises from entry.

    (b)

    Should the owner elect to repair the swimming pool structure, the building official may require the owner to prohibit occupancy of the swimming pool structure until a final inspection is made.
