§ 5-157. Illegal work; suspension or revocation of registration.

  • (a)

    Any person engaged in the mobile home set-up business whose work does not conform to the standards set out in this article, or whose workmanship or materials are of inferior quality, shall on notice from the building official make necessary changes or corrections at once so as to conform to this article; if the work has not been so changed after ten (10) days notice from the building official, the building official may then refuse to issue any more permits until such work has fully complied with the standards of this article.

    (b)

    The building official may appear before the building board of review and request that the registration be suspended because of continuous violations. When the suspension or revocation of such registration is to be considered at any meeting, the person to whom the registration has been issued shall have at least ten (10) days notice in writing of the time and place of such meeting, together with a statement of the grounds upon which it is proposed to revoke such registration.

    (c)

    The grounds for suspension, or permanent revocation, shall be based on the judgment of the building board of review as necessary for the protection of the public and the welfare of the industry where one or more of the following causes are found:

    (1)

    Misrepresentation of any material fact in the application for a certificate, license or permit.

    (2)

    Performance of mobile home set-up work in a negligent, or incompetent manner.

    (3)

    Engaging in the business of mobile home set-up service in violation of this article.

    (4)

    Misrepresentation of the requirements of this article in order to obtain a contract or increase the scope of work in any contract for mobile home set-up work.

    (5)

    Failing to report to the office of the building official any known violations of this article, or attempting to conceal such violations, by any holder of certificate under this article.

    (6)

    Allowing any unqualified person to secure a permit using the certificate holder's name and registration.

    (d)

    Any person aggrieved by action of the building official's office shall have the right of appeal to the building board of review for arbitration of the disagreement.

    (e)

    Any person aggrieved by action of the building board of review shall have the right of appeal, within thirty (30) days of such action, to the board of county commissioners and such other remedies as may be provided by the law.
