§ 10-103. Application sufficiency.

  • The zoning administrator shall be responsible for the distribution and review of the application for a conceptual mine plan or amendments thereto and for the issuance or renewal of operating permits. A completed application along with the filing fee shall be reviewed for a determination of sufficiency and the applicant notified within fourteen (14) days of any deficiencies by the zoning administrator. The public hearings shall be held no sooner than forty-five (45) days after sufficiency is determined. A staff report, containing a written review and recommendation, shall be prepared and transmitted to the board and the applicant within thirty (30) days after the application is determined to be sufficient. Written notification of the board's action on the application shall be transmitted to the applicant within ten (10) days of the board hearings, either indicating approval or giving an explanation of the deficiencies, or other reasons precluding approval.
