§ 10.8-75. Initial street lighting assessment resolution.
(a)
After receipt of a verified petition in compliance with section 10.8-74, the initial proceeding for imposition of a street lighting assessment shall be the board's adoption of an initial street lighting assessment resolution.
(b)
The initial street lighting assessment resolution shall:
(1)
Describe the proposed street lighting assessment area;
(2)
Describe the street lighting services proposed for funding from the proceeds of the street lighting assessments;
(3)
Estimate the street lighting assessed cost;
(4)
Describe with particularity the proposed method of apportioning the street lighting assessed cost among the tax parcels located within the street lighting assessment area in accordance with section 10.8-72 hereof with such modifications, if any, such that the owner of any tax parcel can objectively determine the amount of the street lighting assessment; and
(5)
Include or confirm specific legislative findings that recognize the equity provided by the apportionment methodology and specific legislative findings that recognize the special benefit provided by the street lighting services.
(c)
At its option, the board may adopt separate initial street lighting assessment resolutions for individual street lighting assessment areas or it may include multiple street lighting assessment areas in a single initial street lighting assessment resolution.
