§ 10.5-130. Enforcement.

(a)

Violators of any section of this division may be prosecuted and punished as provided by Section 125.69, Florida Statutes (1999).

(b)

In addition to the penalty provided for in section 125.69, Florida Statutes (1999), adult bookstores, adult theaters, special cabarets, physical culture establishments, or adult photographic and modeling studios in violation of the requirements of this division shall be subject to the appropriate civil action for their abatement. Each day that any such violation is committed shall constitute a separate offense.

(c)

It is the responsibility of the licensee, owner, employee, or operator of an adult use business establishment to ensure compliance with this division, notwithstanding the issuance of an occupational license, building permit, land use clearance for an alcoholic license or any other governmental permit.
