§ 10.3-62. Scope.

The provisions of this division shall regulate nonconsensual towing services which include tows made from private property in compliance with Section 715.07, Florida Statutes, and towing services requested by law enforcement officers without the prior consent or authorization of the owner, lessee, agent, or operator as a result of an emergency situation such as a vehicle crash accident or incident to an arrest. This division shall not be construed to disallow a municipality or law enforcement agency or any other party to contract with tow truck operators for nonconsensual towing services at a lower price. In no event shall Polk County be liable for any injury to persons or property arising out of or resulting from the activities carried out by a tow truck operator hereunder.
