Polk County intends to regulate the maximum price charged for nonconsensual towing
services throughout the incorporated and unincorporated areas of Polk County to protect
consumers and ethical tow truck operators. Currently, the maximum rates for nonconsensual
towing services are set forth in Resolution No. 03-17, and are subject to review and
change from time to time by the board of county commissioners by enacting a new resolution.
The charges described in section 10.3-63 and established from time to time by resolution of the Polk County Board of County
Commissioners are the sole and exclusive charges that may be legally imposed by tow
truck operators in Polk County. Any other charges not identified herein or by resolution
are expressly prohibited, including, without limitation, fuel adjustment charges,
fees to remove personal belongings not attached to the vehicle during normal business
hours, or the like.
