§ 8.7-121. Review requirement.

Latest version.
  • This chapter and the impact fee studies adopted in section 8.7-5 hereof, as may be supplemented and amended, shall be reviewed by the county at least once every five (5) years, unless the county manager determines that a substantial increase in revenues or new revenue sources warrant an earlier review to evaluate and adjust, if appropriate, the impact fees. The initial and each subsequent review shall consider but not be limited to all components of the impact fee studies accepted in section 8.7-5 herein. The purpose of this review is to demonstrate that the impact fees do not exceed reasonably anticipated costs associated with growth-necessitated capital improvements. In the event the review of the ordinance and the impact fee studies required by this section alters or changes the assumptions, conclusions and findings of the impact fee studies accepted by reference in section 8.7-5 then said studies shall be amended and updated to reflect the assumptions, conclusions and findings of such reviews and the impact fees shall be amended in accordance therewith.
