§ 7-5. Privately owned fire hydrants.

  • (1)

    Inspection and maintenance.

    (a)

    All privately owned fire hydrants in unincorporated Polk County that are not maintained by the Polk County water department, municipalities in Polk County or other governmental entities, including fire hydrants maintained by water and wastewater franchises, shall be maintained and inspected annually per the requirements of NFPA 25, as referenced in Section 6-5, NFPA 1, and Section 4-4.3, NFPA 25.

    (b)

    Such inspection and maintenance shall be performed by one of the following:

    1.

    A general contractor licensed in the State of Florida;

    2.

    A utilities contractor licensed in the State of Florida;

    3.

    A fire protection contractor licensed in the State of Florida; or

    4.

    A plumbing contractor licensed in the State of Florida.

    (c)

    The property owner or the franchisee, shall cause to be completed annually a fire hydrant inspection report, the approved version of which is attached hereto. Once completed, a copy of this form shall be forwarded to the Polk County fire marshal's office within thirty (30) days upon completion of the inspection.

    (2)

    Penalty. Any person who refuses to comply with or violates this Ordinance shall be punished according to law and, upon conviction for such offense, by a fine not to exceed five hundred dollars ($500.00) or by imprisonment by a term not to exceed sixty (60) days in the county jail or both.
