§ 5-13. Permit required; penalties for violation.

  • (a)

    It shall be a violation of this section for any contractor to proceed on any job or perform work for which a building permit is required pursuant to an adopted state minimum building code, without such building department permit being in effect. Further, it shall be a violation of this section for any contractor to fail to request any required inspections. (Excluding declared emergency situations.)

    (b)

    There shall be penalties for any contractor that fails to obtain permits or inspections.

    (1)

    Late permits. If a contractor pulls a permit after starting a job, but prior to completion of same and does not miss any inspections the penalty shall be:

    a.

    First violation: Two hundred fifty dollar ($250.00) penalty; plus double permit fee.

    b.

    Second violation: Five hundred dollar ($500.00) penalty; plus double permit fee.

    c.

    Third violation: Five hundred dollar ($500.00) penalty; plus double permit fee and mandatory appearance before the Polk County Contractor Licensing Board.

    If a contractor fails to obtain the necessary building permit and completes a project without any required inspections, the penalty shall be five hundred dollars ($500.00), plus double permit fee.

    (2)

    Failure to call for inspections. If a contractor fails to call for an inspection the penalty shall be:

    a.

    First violation: One hundred dollar ($100.00) penalty.

    b.

    Second violation: Two hundred fifty dollar ($250.00) penalty.

    c.

    Third violation: Five hundred dollar ($500.00) penalty and mandatory appearance before the Polk County Contractor Licensing Board.
