§ 5.5-12. Definitions.

  • For the purpose of this article, certain terms or words used herein shall be interpreted to mean the following, unless another meaning is plainly intended:

    Basic gain time shall mean gain time awarded pursuant to Section 951.21(1) Florida Statutes, for good conduct.

    Board shall mean the board of county commissioners of Polk County, Florida.

    Department shall mean the Polk County Sheriff's Office Department of Detention.

    Department commander shall mean the Commander of the Polk County Sheriff's Office Department of Detention.

    Director shall mean the Commander of the Polk County Sheriff's Office Department of Detention, Support Division.

    Gain time shall mean basic gain time, incentive gain time, and meritorious gain time, all as defined herein.

    Gain time committee shall mean the Inmate Work Supervisor of the Polk County Sheriff's Office Department of Detention or his designee; the Ancillary Section Commander of Detention's Administrative Bureau or his designee, and one member of the Classifications Unit in the Records Section of the Polk County Sheriff's Office Department of Detention; all of whom shall be designated by the director as members of the gain time committee.

    Incentive gain time shall mean gain time awarded to an inmate who faithfully performs assignments in a conscientious manner over and above that normally expected or who faithfully participates in an approved course of academic programs, life learning skills, substance abuse treatment, human growth and development, job training programs or vocational study.

    Inmate and/or prisoner shall mean a person, who is a county pretrial detainee (that will ultimately be sentenced to the county jail) or is under sentence of court upon conviction of a crime, who has been committed to the custody of the Polk County Sheriff's Office Department of Detention.

    Meritorious gain time shall mean sentence deductions awarded to an inmate who does some outstanding deed or performs an outstanding service meriting an additional deduction from the term of his sentence.

    Work program shall mean any inmate work program so designated by the director.
