Chapter 4.4. CABLE COMMUNICATION SYSTEMS

§ 4.4-5. Franchise required for operation of CATV system.

On and after the effective date of this chapter, it shall be unlawful for any person to operate or maintain a cable television system, or any part of such a system, in any area of Polk County not within the boundaries of any municipality unless such person shall be the holder of a franchise granted by the board pursuant to this chapter; provided, however, that any person operating and maintaining a cable television system within the county and outside the boundaries of a municipality on the effective date of this chapter shall be entitled, upon filing an application for a franchise covering the area served within sixty (60) days after the effective date of this chapter, to continue such operation and maintenance pending final action by the board upon its application.
