§ 4.4-3. Definitions.

  • Relevant terms are defined at 47 U.S. Code § 522 and Section 166.046(1), Florida Statutes. However, when used in this chapter, the following terms shall mean:

    Board shall mean the Polk County Board of County Commissioners, the franchising authority.

    CATV shall mean a cable television system as defined at 47 U.S. Code § 522 and Section 166.046(1), Florida Statutes.

    County shall mean Polk County, Florida.

    Franchisee shall mean the person to whom or to which a franchise, as defined in law, is granted by the board under this chapter, and the lawful successor, transferee or assignee of said person.

    Gross annual receipts or gross annual revenues means all revenues derived directly or indirectly by the franchisee, its affiliates, subsidiaries, parents and any other person in which the franchisee has a financial interest, from or in connection with the operation of the cable television system.

    Major stockholder shall mean a beneficial owner, directly or indirectly, of ten (10) per cent of the issued and outstanding voting stock of any corporation.

    Property of franchisee shall mean all property owned, installed or used by a franchisee in the conduct of a CATV business in the county under the authority of a franchise granted pursuant to this chapter.

    Street shall mean the surface of and the space above and below any public street, road, highway, freeway, lane, path, alley, court, sidewalk, parkway, right-of-way, drive, utility easement, ingress and egress easement, or other public property, now or hereafter existing as such within the county.

    Subscriber shall mean any person using or receiving for any purpose the CATV service of a franchisee.
