§ 4.4-14. Franchisee to obtain permits, etc., in timely fashion.

(a)

The franchisee shall make application for and obtain all necessary permits and authorizations which are required in the conduct of its business, and shall commence and complete construction and installation of the system, and shall proceed to render service to subscribers, all within such times as may be provided in the franchise or this chapter.

(b)

Failure on the part of the franchisee to comply with any time requirements referred to in subsection (a) of this section shall be grounds for termination of such franchise, under and pursuant to the terms of section 4.4-9 hereof; provided, however, that the board in its discretion may extend such times for additional periods in the event the franchisee, acting in good faith, experiences delays by reason of circumstances beyond his control.
