§ 2-122. Nuisance abatement board created; composition; terms; removal; organization.

  • (a)

    There is hereby created a nuisance abatement board of Polk County, Florida which shall consist of five (5) members appointed by the board of county commissioners. All members shall be residents of Polk County and shall serve without compensation, but may be reimbursed for such travel, mileage and per diem as may be authorized by the board of county commissioners or as provided by law.

    (b)

    The initial appointments to the nuisance abatement board shall be as follows:

    (1)

    Two (2) members shall be appointed for a term of one year each.

    (2)

    Three (3) members shall be appointed for a term of two (2) years each.

    Thereafter, each appointment shall be for a term of two (2) years. Appointments to fill any vacancy on the nuisance abatement board shall be for the remainder of the unexpired term.

    (c)

    If any member fails to attend two (2) of three (3) successive meetings without cause, and without the prior approval of the chairman, the board shall declare the member's office vacant; and the board of county commissioners shall promptly fill the vacancy.

    (d)

    The members of the nuisance abatement board serve at the pleasure of the board of county commissioners.

    (e)

    At the first meeting of the nuisance abatement board, the members shall select a chairman and a vice-chairman. The presence of three (3) or more members shall constitute a quorum of the nuisance abatement board.

    (f)

    Regular meetings of the board shall occur no less frequently than once every three (3) months, but the board may meet as often as necessary. Meetings may also be called by the chairman of the nuisance abatement board or by at least three (3) members of the board by written notification to the chairman.

    (g)

    Minutes shall be maintained of all meetings and all hearings and proceedings shall be open to the public.

    (h)

    The board of county commissioners shall provide clerical and administrative support to the board as may be reasonably required by the board for the proper performance of its duties.

    (i)

    A member of the county attorney's staff shall attend meetings of the board and assist the board in the conduct of its hearings.
