§ 2-31. Filing fees.

  • (a)

    Definitions.

    Clerk means the clerk of courts for Polk County, Florida.

    Circuit court means the Tenth Judicial Circuit [Court] for the State of Florida.

    County means Polk County, Florida.

    County court means the county court for Polk County, Florida.

    (b)

    Imposed. Pursuant to the authority contained in Sections 34.041, 28.2401, and 28.241, Florida Statutes, service charges in excess of the filing fees fixed therein are hereby imposed. Upon the institution of any civil action or proceedings, the plaintiff, when filing his action or proceedings, shall pay the following service charges:

    (c)

    Collection and distribution of funds. The proceeds of service charges in excess of those fixed by sections 34.041, 28.2401 and 28.241, Florida Statutes, shall be paid to the clerk of the circuit and county courts and by him paid monthly into the appropriate fund of the county.

    (1)

    Law library. The proceeds of filing fees designated for the law library shall be used for the purpose of providing and maintaining a law library available for use of the county court and circuit court. Said funds shall be merged with the law library fund appropriated for Polk County Law Library purposes and expended in the same manner.

    (2)

    Legal aid program. The proceeds from the fees designated for funding the Heart of Florida Legal Aid Society, Inc., shall be paid monthly by the clerk to said organization.

    (3)

    Court facilities. The proceeds designated for court facilities shall be used for the purpose of providing and maintaining court facilities available for the use of the circuit and county courts.
