§ 12-187. Variance.

  • The public works director is authorized to grant variances from provisions of this article in circumstances where deviations involved will not result in unreasonable risk to the public health, safety, or welfare nor cause damage to the environment. A variance from the standards contained in this rule shall be considered only where the following criteria can be satisfied:

    (1)

    The applicant has not intentionally created a hardship condition.

    (2)

    The proposed variance will not adversely affect the public health, safety, or welfare nor cause environmental impairment.

    (3)

    The requested variance will not violate other existing federal, state or county rules, statutes, or ordinances. The applicant shall submit a written request for variance to the public works director along with all supporting documentation for the request. The public works director shall issue a written decision within thirty (30) days of receipt of all required or requested additional information.

    (4)

    In addition to [subsections] (1), (2), and (3) of the above criteria, variance requests concerning land spreading activities within the boundaries of the Green Swamp Area of Critical State Concern will be subject to review and approval by the Florida Department of Community Affairs.
