§ 12-78. Action on applications.

(a)

The director of the Polk County utilities division, hereinafter the "director," shall receive the application and within thirty (30) days shall recommend approval or denial of the application to the commission. Such recommendation shall be in writing and shall be supported by specific findings, and a copy shall be forwarded to the applicant not later than twenty (20) days prior to the time designated by the commission for public hearing.

(b)

The commission shall conduct a public hearing pursuant to notice and shall, within ten (10) days either grant or deny such application, upon such conditions, as the commission may deem to be in the public interest. Such grant or denial shall be in writing and shall be supported by specific findings.
