§ 12-76. Application for franchise.

(a)

Each applicant for a franchise to provide water or sewer service shall:

(1)

Provide information required by the commission which may include a detailed inquiry into the ability of the applicant to provide service, the territory or facilities involved, and the existence or nonexistence of service from other sources within geographical proximity to the territory applied for.

(2)

File an application fee as provided for in section 12-84.

(3)

The application shall be filed with the commission.

(b)

Within sixty (60) days thereafter the commission shall schedule a hearing on the application, said hearing shall be held not more than ninety (90) days after the filing of the application.
