§ 11-7. Presumption concerning illegal dumping.

  • If any solid waste is disposed on public or private property in violation of this chapter or of other applicable law and the generator of such waste can be identified by using materials contained within the solid waste, or by using other methods or evidence, it shall be presumed that the generator placed the solid waste on the property where the solid waste was found notwithstanding who may have actually placed the solid waste on the site. Under such circumstances, the presumed generator shall be responsible for the immediate removal and proper disposal of such waste. If the presumed generator fails to immediately remove and properly dispose of the waste, then the county may elect to do so and the presumed generator shall pay the county the full amount of all costs and expenses the county incurs to remove and dispose of the waste including, but not limited, to the costs and expenses related to the investigation and prosecution of the illegal dumping.
