§ 11.8-23. Modification and renewal of certificates.

  • (a)

    The board of county commissioners may permit modification or amending of certificates of public convenience and necessity during their effectiveness due to changes in circumstances. No substantial modification or amending shall be made without adequate notice and an opportunity for all interested and substantially affected persons to be heard.

    (b)

    At least one hundred eighty (180) days prior to the expiration of its certificate, each provider must file an application for renewal of its certificate on forms to be provided by the division. Following notice to same parties that receive notice in Section 11.8-19 and review and recommendation by the division, the renewal application may be granted by the board of county commissioners. A public hearing may be required by the board of county commissioners. If the board of county commissioners determines that a public hearing is to be held on the application, the same parties that receive notice in Section 11.8-19 above shall be entitled to notice of the hearing. Notice shall also be published in a newspaper of general circulation at least ten (10) days prior to the hearing.
