§ 10-111. Setbacks from waste clay settling areas.

Notwithstanding the provisions outlined above, no waste clay area shall be located within five hundred (500) feet of any navigable waterway or public right-of-way. The five hundred (500) feet shall be measured from the centerline of the paved road to the toe of the dam or from the twenty-five-year floodplain of the waterbody to the toe of the dam.
