§ 10.8-71. Street lighting assessments.

(a)

The board is hereby authorized to impose street lighting assessments against property located within a street lighting assessment area. The street lighting assessed cost may be assessed against property located within a street lighting assessment area at a rate of assessment based upon the special benefit accruing to such property from the street lighting service provided by the county.

(b)

Notwithstanding the foregoing, if the board specifically determines that any portion of a street lighting assessment area receives a distinct special benefit from any component of the street lighting service that is materially different in kind or degree from the special benefit received by other portions of a street lighting assessment area, the street lighting assessed cost related to such component shall be assessed against the portion of the street lighting assessment area receiving the distinct special benefit.
