§ 10.7-20. Supervision and regulation of development.

  • Following the issuance of a permit, the following rules and regulations shall be administered and controlled by the board of county commissioners in the following manner:

    (a)

    Personnel of the county code enforcement department shall have the right of entry at all reasonable times upon any property covered by a permit for the purpose of inspection. Designated representatives of the permittee, if available on the premises, shall have the right to accompany any county representatives during inspection.

    (b)

    Copies of all reports or notices required by the permittee by any agency or department of the state specifically including but not restricted to the department of environmental resources and the appropriate water management authority, shall be provided to the county planning department.

    (c)

    If at any time during the term of the permit the permittee fails to comply with these rules and regulations, or the appropriate rules and regulations of other departments or agencies of the county, the state or the federal government, the building official shall immediately notify the permittee in writing and shall order corrective action.

    (d)

    The permittee shall comply with such notices and orders within a reasonable time period and will report such compliance in writing to the building official. The permittee may appeal the orders of the building official to the board of county commissioners within ten (10) days following receipt of such order.

    (e)

    Should the permittee fail to comply with such order in a reasonable period of time, either as issued by the building official or as directed by the board of county commissioners upon appeal, the board may suspend or revoke the permit.

    (f)

    Permits are issued to the owner of the land and such permit shall be transferable upon notice to the issuing agency.

    (g)

    The division of state planning shall receive a copy of all permits issued in the critical area.
