§ 10.5-173. Enforcement procedures.

  • After a minor who violates a curfew is taken into custody, the local law enforcement agency shall:

    (a)

    Have the suspected minor identify themselves by name, age, and address;

    (b)

    Make every reasonable effort to verify the name, age, and address of the suspected minor through written documentation, or through contact with a parent;

    (c)

    If the person is a minor, ascertain the minor's reason for being in the public place or establishment during restricted hours;

    (d)

    Determine if the minor is in violation of this article;

    (e)

    If the law enforcement officer takes the minor into custody, the law enforcement officer shall issue a protective ordinance citation and shall attempt to contact the parent of the minor and, if successful, request that the parent respond to a designated location to take custody of the minor;

    (f)

    If the law enforcement officer is not able to contact the minor's parent within a reasonable amount of time after the minor is taken into custody, or if the parent refuses to take custody of the minor, then the receiving officer shall transport the minor to the Juvenile Assessment Center (JAC) for final disposition and may proceed as authorized under Part II of Chapter 985, Florida Statutes (Dependency Cases).
