§ 10.5-169. Exceptions.

  • A minor is exempt from this article if the minor is:

    (a)

    Accompanied by a parent or other person at least twenty-one (21) years of age having the care and control of the minor with the parent's permission;

    (b)

    Engaged in a lawful employment activity or traveling to or returning home from a lawful employment activity, without any detour or stop and by using the most direct route;

    (c)

    Engaged in interstate travel;

    (d)

    On an errand with the written permission of the minor's parent without any detour and by using the most direct route;

    (e)

    Involved in or attempting to remedy, alleviate or respond to an emergency;

    (f)

    Attending a school, religious, or recreational activity supervised by adults at least twenty-one (21) years of age and sponsored by a Polk County municipality, Polk County, the Polk County School Board, or a charitable, civic, or religious organization or other similar entity which organization takes responsibility for the minor as an invitee, or going to or returning from any such activity, without any detour and by using the most direct route;

    (g)

    On the sidewalk abutting the minor's residence or abutting the residence of a next-door neighbor if the neighbor has not complained to the sheriff's office about the minor's presence;

    (h)

    On the swale of the minor's residence which is the low tract of land in front of or between houses which is often used for drainage;

    (i)

    Exercising First Amendment rights protected by the United States Constitution (or those similar rights protected by Article 1, Sections 3, 4, and 5 of the Florida Constitution), such as free exercise of religion, freedom of speech, and the right of assembly;

    (j)

    Married or has been married in accordance with law or had the disability of nonage removed by a court of competent jurisdiction;

    (k)

    Homeless, or uses a public or semi-public place as the minor's usual place of abode; and

    (l)

    When the county commission, pursuant to an application by a sponsor of an event not provided for in these exceptions, authorizes minors to be in a public place or establishment during restricted hours.
