§ 10.5-96. Same—Investigation; approval or disapproval.

  • (a)

    Upon receipt of an application properly filed with the development services division and upon payment of the nonrefundable application fee, the development services division shall immediately stamp the application as received and shall immediately thereafter send photocopies of the application to the departments. Each department shall promptly conduct an investigation of the applicant, the application, and the proposed establishment, in accordance with its responsibilities summarized in subsections 10.5-91(b) through (f) of this division and to ascertain the validity of the information provided. At the conclusion of its investigation, each department shall indicate, on the photocopy of the application, its approval or disapproval of the application, including the date of approval or disapproval; the signature of the person approving or disapproving the application; and in the event it is disapproved, the reason for disapproval.

    (b)

    A department shall disapprove of an application if it finds that the proposed establishment will be in violation of any provision of any statute, code, ordinance, or regulation in Polk County. After its indication of approval or disapproval, each department shall immediately return the photocopy of the application to the division of development services.
